The rules of the road for using ZapTheMove.

These Terms of Service ("Terms") govern your access to and use of the ZapTheMove website and software services (together, the "Service") operated by ZapTheMove ("we," "us," or "our"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.
ZapTheMove provides AI-powered software tools for household moving companies — including lead capture, automated quoting, dispatch, customer communications, and reporting. We may change, improve, or remove features from time to time. We'll give reasonable notice for changes that materially reduce the value of the Service for paying customers.
You're responsible for keeping your account credentials confidential and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that pose a risk to other users.
You agree not to:
You own the data you and your customers put into the Service ("Customer Data"). You grant us a limited license to process Customer Data solely to operate the Service for you, consistent with our Privacy Policy. We'll never sell Customer Data and we'll never use it to train shared/general AI models without your explicit consent.
Paid plans are billed monthly in advance. You can cancel at any time; cancellation takes effect at the end of the current billing period and we don't issue prorated refunds for partial months unless required by law. Prices may change with at least 30 days' notice — if we raise your price, you can cancel before the new price takes effect.
The Service — including the software, branding, and content we create — is owned by ZapTheMove or our licensors and is protected by copyright, trademark, and other laws. You may not use our trademarks without our prior written permission.
The Service may integrate with third-party services (for example, payment processors, telephony providers, accounting software). Those services have their own terms; we're not responsible for their behavior.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL MEET ANY PARTICULAR REQUIREMENT. AI OUTPUTS ARE INHERENTLY VARIABLE — YOU AGREE TO REVIEW AI-GENERATED CONTENT BEFORE RELYING ON IT FOR CRITICAL BUSINESS DECISIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, ZAPTHEMOVE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold ZapTheMove harmless from claims arising out of your violation of these Terms, your misuse of the Service, or your Customer Data — except to the extent caused by our own negligence or breach of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination we'll give you a reasonable window to export your Customer Data.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction.
We may update these Terms from time to time. We'll post the new version here and update the "Last updated" date. For material changes affecting paying customers, we'll notify you by email at least 30 days in advance.
